TERMS OF USE AND SERVICE AGREEMENT

THESE TERMS OF USE GOVERN YOUR USE OF THE ZYURL.COM WEBSITE AND RELATED SERVICES. PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE SITE AND SERVICES. SPECIFICALLY, REVIEW SECTION 15 CAREFULLY AS IT DESCRIBES HOW DISPUTES BETWEEN US SHALL BE HANDLED, WHICH MAY AFFECT YOUR RIGHTS TO BRING OR PARTICIPATE IN A LAWSUIT.

1. This Agreement

Acceptance of Terms

This agreement is an electronic contract that sets out the legally binding terms ("Terms") governing your use of the ZyURL.com website (the "Site") and its services ("Services"). Each time you access or use ZyURL, you agree to be bound by these Terms. If you disagree, you must discontinue using ZyURL immediately. The Site is owned by ZyURL. All references to "us", "our", or "we" refer to ZyURL.

Updates to Terms

We may update these Terms at any time by posting the latest version on ZyURL.com. Changes will take effect from the "Effective Date" shown. Continued use of ZyURL after updates constitutes agreement to the new Terms.

By accessing ZyURL, you consent to receive these Terms and related notices in electronic form.

2. The Services; User Account

Description

ZyURL allows users to create shortened URLs, branded links, custom bio pages, QR codes, tracking pixels, and offers advanced link management and analytics. Some services are free, while others require a paid subscription.

User Account

  • Eligibility: You must be 18+ and not prohibited by law from using our services.
  • Authorized Users: You may allow others (team members) to access your account, but you remain responsible for their use.
  • User Warranties: You agree to:
    • Provide accurate and up-to-date information.
    • Not use ZyURL to distribute unlawful, harmful, defamatory, or spam-related material.

Violation of these Terms may result in suspension or termination of your account.

3. ZyURL's Rights

We reserve the right to reject, suspend, or terminate any account at our sole discretion, especially if Terms or laws are violated.

4. Subscriptions; Billing via Paddle

Billing

If you select a paid subscription, you authorize ZyURL’s payment processor, Paddle, to charge you based on your chosen plan. Paddle handles payment collection, taxes, and billing processes. All subscription fees are in USD.

Free Trials or Promotions

Some plans may include a free or discounted trial. After the trial, regular billing resumes unless canceled beforehand.

Cancellation & Refunds

  • Cancel anytime via your account dashboard.
  • Full refunds are available within the first 30 days of subscription or within 14 days of a non-usage payment period—contact support@zyurl.com for assistance.
  • Monthly Plans: Access continues until the end of the paid period; no further charges apply post-cancellation.
  • Annual Plans: Access continues until the end of the period. Prorated refunds (minus a cancellation fee) may be available upon request.

You must maintain accurate billing information and promptly notify us via support@zyurl.com if changes occur.

5. Proprietary Rights

All materials on ZyURL.com (text, graphics, software, etc.) are the property of ZyURL or its licensors, protected by copyright and trademark laws. Unauthorized use or reproduction is prohibited.

6. User Submissions

By submitting content (e.g., testimonials) to ZyURL, you grant us a perpetual, royalty-free license to use, modify, and promote such content globally.

7. Links to External Sites

ZyURL may contain third-party links. We are not responsible for their content or accuracy. Access external sites at your own risk.

8. Indemnity

You agree to indemnify ZyURL, its affiliates, officers, and agents from any claims or liabilities arising from your use of ZyURL or violation of these Terms.

9. Disclaimers

ZyURL and all services are provided "AS IS" without warranties of any kind. We do not guarantee uninterrupted, error-free service or specific outcomes. Use ZyURL at your own risk.

10. Limitation of Liability

ZyURL and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Total liability, if any, is limited to $10.

11. Termination

We reserve the right to suspend or terminate your access to ZyURL if you violate these Terms. Upon termination, all rights and access will cease immediately.

12. Access Conditions

You must comply with these Terms to continue accessing ZyURL services. We may revoke access at any time for conduct harmful to ZyURL’s business.

13. Privacy

ZyURL follows a strict Privacy Policy, incorporated herein. Our Data Processing Agreement (DPA) applies where applicable under GDPR regulations.

14. Dispute Resolution & Governing Law

Informal Resolution

Before initiating legal proceedings, contact us at support@zyurl.com to resolve disputes informally.

 

15. Miscellaneous

  • These Terms, along with the Privacy Policy, constitute the entire agreement between you and ZyURL.
  • If any part of these Terms is found unenforceable, the remaining provisions remain valid.
  • Failure by ZyURL to enforce any part of these Terms does not waive our right to enforce them later.
